The HJC Unifies Enforcement Procedures in First Instance and Conciliation Courts

The Honorable Chief Justice Issa Abu Sharar, Head of the High Court, issued a memo to judges from First Instance, Conciliation, and Enforcement Judges. The memo announced the unification of enforcement measures in all courts covering all procedures starting from filing until disposition. The Chief Justice explained that the unified procedures would be fully introduced in a training session, which would occur at a later date.

 

The unification will involve three aspects: registering the case, managing the course of the file, and settling the file and its dues. The decision also includes the separation of inactive files. This procedure will include searching all active files for those with no action for six months or more. These files will then be separated from the active files and sent to the correct judge to either dismiss or continue them. The decision also emphasizes that if the file is settled, the court staff must assure that prior to the decision all monies related to the file are paid and the contact information for the plaintiff and defendant are current. To increase the likelihood of satisfying money owed, it calls for an immediate hearing to determine if the debtor can pay, which will avoid an increase in pending cases and satisfy debts sooner.
